16 LGBT Activists Released In Uganda, Condemn Police Conduct and Anal Exams

16 Ugandan LGBT activists were released from jail Thursday on bond in Kampala after six days in detention. They are charged with carnal knowledge against the order of nature (homosexuality) and human trafficking.

This follows the arrest of the 16 activists from Let’s Walk Uganda, on Friday after their office in Kyengera, about an hour’s drive from Uganda’s Capital City, Kampala. came under attack from a mob that was trying to break into their office,  chanting anti-gay obscenities  and threatening  to lynch them. The activist called on police for protection. The police indicated that the activists would be given protective custody.

However,  while at the police station, police instead placed them under arrest on charges of carnal knowledge against order of nature and human trafficking after searching their office and finding water-based sex lubricants satchets, antiretroviral drugs and condoms Police officers told the activists that there was enough evidence to prove they were indulging in homosexual practices.

The activists were later subjected to forced anal examinations, despite protests by the LGBT+ community.

Dr. Jane Aceng. and former Ugandan Inspector General of Police IGP, Kale Kayihura, criticized the use of forced anal exams,

Frank Mugisha, Executive Director of Sexual Minorities Uganda (SMUG).  released the following statements:.

The Government is not only failing to protect us—they are also violating our rights as Ugandans with sham criminal charges designed to silence us and forced anal exams to humiliate and torture us,” said Frank Mugisha, Executive Director of Sexual Minorities Uganda (SMUG). “Our communities are demanding that the charges against these 16 defendants be immediately dropped.”

Two Ugandan cabinet minister on Friday evening issued public statements condemning the attacks on LGBT+ community in Uganda.

The Uganda Anti-Homosexuality Act, 2014 was passed in December 2013 with a punishment of life in prison for “aggravated homosexuality. In August 2014, the Uganda Constitutional Court annulled the law. Nonetheless, LGBT people continue to face major discrimination in Uganda, actively encouraged by political and religious leaders. Violent and brutal attacks against LGBT people are common, often performed by state officials. Households headed by same-sex couples are not eligible for the same legal protections available to opposite-sex couples. Same-sex marriage has been constitutionally banned since 2005.

For the past two years we have heard about the case against Springfield, Massachusetts “Pastor” an anti-LGBT activist and the  “crimes against humanity” lawsuit brought against him by Ugandan human rights activists.  Lively and his virulent views about homosexuality at a 2009 anti-gay conference in Uganda is widely believed to have played a role in the drafting of Uganda’s notorious “kill the gays” bill.  and was accused of collaborating with Ugandan officials to institute the death penalty for homosexuals.

Today the lawsuit was dismissed because  “based on lack of jurisdiction.”

“Plaintiff has filed this lawsuit under the Alien Tort Statute (“ATS”), 28 U.S.C. § 1350, seeking monetary damages and injunctive relief based on Defendant’s crimes against humanity. Defendant now seeks summary judgment in his favor arguing that, on the facts of record, the ATS provides no jurisdiction over a claim for injuries — however grievous – – occurring entirely in a foreign country such as Uganda. Because the court has concluded that Defendant’s .jurisdictional argument is correct, the motion will be allowed.

“Anyone reading this memorandum should make no mistake. The question before the court is not whether Defendant’s actions in aiding and abetting efforts to demonize, intimidate, and injure LGBTI people in Uganda constitute violations of international law. They do. The much narrower and more technical question posed by Defendant’s motion is whether the limited actions taken by Defendant on American soil in pursuit of his odious campaign are sufficient to give this court jurisdiction over Plaintiff’s claims. Since they are not sufficient, summary judgment is appropriate for this, and only this, reason.”

In conclusion:
“For the foregoing reasons, Defendant’s motion for summary· judgment (Dkt. No. 248) based on lack of jurisdiction is hereby ALLOWED. As noted, the court will decline to exercise supplemental jurisdiction over the two purely state .law claims·. As to them, the motion for summary judgment is ALLOWED, without prejudice to re-filing in state court if Plaintiff desires. The clerk will enter judgment of dismissal. This case may now be closed.

Judge Rules That Anti-gay Scott Lively Must Stand Trial for Crimes Against Humanity In Uganda

A Ugandan LGBT advocacy organization which had filed a lawsuit against prominent US anti-gay extremist Scott Lively who is accused of engineering the Uganda ‘Kill The Gays’ bill, received good news when a federal court judge ruled that Lively must stand trail for crimes against humanity for his part in helping to push and engineer Uganda’s “Kill the Gays” bill

Lively stands accused of helping to play a part in the persecution, arrest and murder of gay people in Uganda.  Lively’s lawyers requested to dismiss the lawsuit, but now a federal US judge has ruled a persecution of LGBT people is indeed a crime against humanity and that Lively must stand trial.

Michael Ponsor, the US District Judge in Springfield, Massachusetts, said: ‘Widespread, systematic persecution of LGBT people constitutes a crime against humanity that unquestionably violates international norms.’

‘The history and current existence of discrimination against LGBT people is precisely what qualifies them as a distinct targeted group eligible for protection under international law.

‘The fact that a group continues to be vulnerable to widespread, systematic persecution in some parts of the world simply cannot shield one who commits a crime against humanity from liability.’

Frank Mugisha, director of Sexual Minorities Uganda, said: ‘Today’s ruling is a significant victory for human rights everywhere but most especially for LGBTI Ugandans who are seeking accountability from those orchestrating our persecution.

Lively the founder of Abiding Truth Ministries, an officially recognized hate group has made a career of stirring up anti-gay feelings in the USA and across the world.

He co-authored The Pink Swastika, which suggests ‘homosexuals were the truth inventors of Nazism and the guiding force behind many Nazi atrocities’ and the rainbow flag is a symbol of the ‘end times’.

In 2007, Lively also toured 50 cities in Russia where he is accused of recommending a ban on ‘gay propaganda’ and in 2011 was a driving force is pushing Uganda’s anti-gay laws.

Extremist Hate Preacher Scott Lively Responds To Lawsuit Charging Him With The Murders Of Gay Ugandans

“I am an American citizen [being targeted] over the persecution of homosexuals as they define it as a crime against humanity for speaking the truth of the Bible in a foreign country. Frankly, I don’t this is actionable. They make it clear that this suit is premised on speeches or writings. I spoke to members of parliament in their assembly hall, and advised them to focus on therapy and not punishment. What they’re suggesting here is that the duly elected legislative representatives of Uganda, the cream of Ugandan society, cannot be responsible for their own actions – that they adopted legislation because a white evangelical came and said something to them.”

Above is the response given by Christian extremist hate preacher Scott Lively one day after The Center for Constitutional Rights filed a lawsuit on behalf of Sexual Minorities of Uganda (SMUG) in Massachusetts for inciting the persecution and the murder of homosexuals in their country of Uganda.

Lively would do well to remember that the so called “”cream of Ugandan society” of the  current Ugandan Government shot its way into power with child soldiers.  A very low and curdled  standard for the “cream of society”.   And as for being an “American citizen” so were Charles Manson, Ed Gein, Richard Speck and Ted Bundy.

This is a great opportunity  for Scott Lively to defend his hateful work in an American court of law and be exposed as the hateful, evil, charlatan that he really is for the entire world to see

Ugandan LGBT Rights Group Sues Hate Preacher Scott Lively For Murders Of Gay Ugandans

The Center for Constitutional Rights has announced this morning that they are filing a lawsuit on behalf of Sexual Minorities of Uganda (SMUG)  in Massachusetts to be brought against LGBT evangelical hate preacher Scott Lively for inciting the persecution and the murder of homosexuals in their country of  Uganda.

The lawsuit alleges that beginning in 2002, Mr. Lively conspired with religious and political leaders in Uganda to whip up anti-gay hysteria with warnings that homosexuals would sodomize African children and corrupt their culture. The Ugandan legislature considered a bill in 2009, proposed by one of Mr. Lively’s Ugandan contacts, that would have imposed the death sentence for homosexual behavior. That bill was at first withdrawn after an outcry from the United States and European nations that are among major aid donors to Uganda, but a revised bill was reintroduced last month. Mr. Lively is being sued by the organization Sexual Minorities Uganda under the alien tort statute, which allows foreigners to sue in American courts in situations alleging the violation of international law. The suit claims that Mr. Lively’s actions resulted in the persecution, arrest, torture and murder of homosexuals in Uganda.

Lively response to the NYT’s :  “That’s about as ridiculous as it gets. I’ve never done anything in Uganda except preach the Gospel and speak my opinion about the homosexual issue. There’s actually no grounds for litigation on this.”

In January 2011 shortly after a visit from Lively and other visiting American evangelicals urging Ugandans to take a “strictly biblical” attitude towards gay people, Ugandan gay activist David Kato was murdered after his photo was published in a local paper under the headline “HANG THEM!”
