Federal Judge Blocks PrEP Coverage Under Affordable Care Act- “Obamacare”

A federal judge in Texas (of course) on Thursday blocked the Affordable Care Act aka Obamacare’s mandate that health insurance plans cover preventive care against HIV (PrEP), at no cost to patients.

U.S. District Judge Reed O’Connor a Republican appointed by George Bush in Fort Worth, Texas, previously found that the PrEP mandate violated a federal religious freedom law and that other no-cost preventive care mandates were based on recommendations by an illegally appointed task force. Now the judge has now blocked the federal government from enforcing the mandates.

The legal challenge was brought by eight individuals and two businesses, all from Texas. They argued that the free PrEP requirement requires business owners and consumers to pay for services that “encourage homosexual behavior, prostitution, sexual promiscuity and intravenous drug use” despite their religious beliefs.

The conservative America First Legal Foundation is helping to represent the plaintiffs. The group was founded by neo-Nazi Stephen Miller, who served as an adviser to Republican President Donald Trump.

American Medical Association President Jack Resneck called it “deeply flawed” and said that patients “will be subjected to needless illness and preventable deaths” as a result.

Leader McConnell has announced that next week, the Senate will vote on the Obamacare Repeal Reconciliation Act, the same 2015 Obamacare repeal bill that Congress successfully passed and put on former President Obama’s desk, who vetoed it! Now, we finally have a president in Donald Trump who will sign this legislation!

Like the 2015 bill, the Obamacare Repeal Reconciliation Act would repeal several key pillars of Obamacare and eliminate for one year more than $390 million (over 86 percent) of over $450 million in annual federal funding to Planned Parenthood. The bill would also repeal Obamacare’s premium tax credits that currently provide over $8.7 billion in annual subsidies for nearly 1,000 health care plans that cover elective abortion. This violates the principles of the Hyde Amendment, which restricts federal subsidies for elective abortion services or coverage. Most of the bill’s repeal provisions would take effect in 2020, after a two-year delay. Congress then will have time to work on a separate replace bill.

In order for the Senate to get to the Obamacare Repeal Reconciliation Act, at least 50 Senators must first support a procedural vote to overcome Senate Democrats’ opposition to even considering the bill. All but one Republican senator holding office today previously voted for the same repeal bill in 2015. We cannot let Senate Republicans betray the American people by going back their promise to repeal Obamacare and defund Planned Parenthood.

On Wednesday, the Congressional Budget Office issued a report that estimated the effects of the Senate bill that Perkins writes about, which would repeal most of Obamacare without immediately replacing it with a new health-care law. would increase the number of people without health insurance by 32 million people above the number that would be uninsured if the current law remained in place.

The repeal bill also would double insurance premiums in the individual plan market and leave up to three-quarters of the United States without an insurer selling such plans by 2026.

Trump Praises Australia’s FREE Universal Health Care After The Potential Killing Of Obamacare

Hours after scoring a victory in the House to effectively kill Obamacare, US President Donald Trump praised

US Senator Bernie Sanders quickly picked up on the remark which came after Trump’s new bill passed by a handful of votes. The new law still has to pass the US Senate.

Republican House Speaker Paul Ryan has pulled his Obamacare repeal bill from the floor Friday, a day after President Donald Trump had threatened to walk away from health care reform if he didn’t get a vote.

Ryan rushed from the White House to Capitol Hill to tell Trump he did not have the votes to pass the measure, the culmination of seven years of Republican efforts to eradicate President Barack Obama’s proudest domestic achievement.
As Ryan presented the dire vote totals in his meeting with Trump, he explicitly recommended the President pull the bill, according to a senior GOP official. The decision was ultimately Trump’s. Trump made the call at 3 p.m., as the rest of House leadership was gathering in Ryan’s office.
 
Ryan told fellow Republicans they are “moving on” from health care, Reps. Andy Barr and Bill Flores told CNN.
Before the vote was canceled, White House press secretary Sean Spicer said Friday afternoon that Trump has “left everything on the field when it comes to this bill.”

The decision means the ACA remains in place, and a major GOP campaign promise goes unfulfilled. It also casts doubt on the Republican Party’s ability to govern and to advance other high-stakes agenda items, including tax reform and infrastructure spending. Ryan is still without a signature achievement as speaker — and the defeat undermines Trump’s image as a skilled dealmaker willing to strike compromises to push his agenda forward.

Senate Republicans took the first steps towards dismantling Obamacare Tuesday afternoon, filing a budget resolution that puts the wheels in motion for “overhauling”, but in reality actually repealing the Affordable Care Act (ACA) as we know it.

The health care law has reduced the rate of uninsured Americans to the lowest ever recorded and provided health care coverage to 20 million people who previously lacked it.

After Republicans met again on Wednesday to discuss the Affordable Care Act, Vice President-elect Mike Pence came out vowing to repeal the law.

“The first order of business is to repeal and replace Obamacare, and that was our message today and that will be our message on Capitol Hill,” Pence told reporters after the meeting.

At the same time, Obama met with House Democrats to plot ways to slow the Republican drive and defend parts of his signature law. Republicans already control the House and Senate, and after Trump takes office later this month they’ll have the power to gut Obamacare.

Although repeal of the law is now almost a virtual certainty, it’s far from clear what will replace it. Republican leaders said they are exploring a variety of market-based options that would lower costs, give Americans more choice and reduce government’s role in the health care system.

Yet Republicans are expected to need a property manager? Why? Because as they work out a replacement. “We don’t want people to be caught with nothing,” said Paul Ryan, speaker of the House.

Democrats were skeptical. They contend the elimination of Obamacare will “make America sick again,” a twist on Trump’s campaign theme.

“They don’t have a replacement plan,” said Rep. Nancy Pelosi, the leader of House Democrats. “To repeal and delay is an act of cowardice” that could jeopardize the health care of millions of Americans, especially seniors who receive Medicare.

Republicans  argue that a more market-based approach will increase competition in the health-care market and lead to lower prices despite the fact that health-care costs in the U.S., already the highest in the industrial world because it is a “for profit” business.

The Affordable Care Act, signed into law in 2010 and has since benefited millions of Americans needing access to affordable health insurance—including people living with HIV and other pre-existing conditions.

An estimated 20 million Americans are liable to lose their health insurance if the ACA is repealed.

Today’s majority ruling disregards decades of case law that drew a protective line between free religious expression and religious dominance of others. It is a radically dangerous decision that invites more misguided actions contrary to essential protections for employees, customers and the public. It is imperative that the U.S. Congress amend the federal Religious Freedom Restoration Act to withdraw the blessing the Court mistakenly has given these companies to impose their beliefs on working women. Today’s ruling is about the ACA and women’s reproductive health and rights, but some may mistake this narrow ruling as a wide open door for religious liberty exemptions from other statutes that protect employees and the public. Today’s opinion says doing so would be incorrect. However, recent mistreatment of LGBT people in employment and other commercial settings still makes this extremely troubling. A business owner’s religious objection to a worker’s same-sex spouse or a customer’s LGBT identity is not acceptable grounds for discrimination. It is more important than ever that states and Congress enact strong, clear nondiscrimination protections for LGBT people.

The majority’s holding that closely held corporations can claim religious liberty protections designed for individuals—and can rely on those protections to avoid complying with generally applicable laws—is a dangerous and radical departure from existing law that creates far more questions than it answers and shows a callous disregard for the health care needs of women workers. Thankfully, however, the majority recognized that even under its sweeping new rule, corporations cannot rely on claims of religious liberty to evade non-discrimination laws. That limitation is extremely important and means that employers cannot exploit today’s decision to justify non-compliance with laws that prohibit discrimination against LGBT people and other vulnerable groups, but we will need to be vigilant to make sure that principle is respected and enforced.

Today’s decision from five male justices is a direct attack on women and our fundamental rights. This ruling goes out of its way to declare that discrimination against women isn’t discrimination.

 Allowing bosses this much control over the health-care decisions of their employees is a slippery slope with no end. Every American could potentially be affected by this far-reaching and shocking decision that allows bosses to reach beyond the boardroom and into their employees’ bedrooms. The majority claims that its ruling is limited, but that logic doesn’t hold up. Today it’s birth control; tomorrow it could be any personal medical decision, from starting a family to getting life-saving vaccinations or blood transfusions. 

Ninety-nine percent of women use birth control at some point in our lives, and none of those stories made it into the arguments. It’s outrageous that these five male justices chose to single out birth control for special discrimination.

Tea party activist, author, and right-wing extremist lunatic James Corsi is claiming that gay people with AIDS are being enlisted by the Obama administration to destroy the health insurance system and usher in socialized medicine.

Corsi whi writes columns for Wingnut World Daily and pushes the theory that explosives inside the TWC buildings, not just the planes hitting them, during the attacks states that “The Obama administration’s emphasis on enrolling the LGBT community in Obamacare strongly suggests it has an unspoken agenda of shifting to healthy citizens the extraordinary financial burden of providing services to the unique demographic, which is afflicted disproportionately by AIDS and other health issues,” Corsi wrote in a Dec. 25 column. (Corsi also believes that “Obamacare will lead to death panels”

“You’re going to spend a minimum of $30,000 to $40,000 a year just for the treatments to keep someone with HIV infection alive, and probably extending their life for 20 years is going to cost about a million dollars. Now that cost has got to be borne somewhere.

Even the HIV/AIDS community is going to have to wonder if they’re going to be paid $30,000, $40,000 (or) $50,000 — up to $500,000 a year — for their treatments under a government system,

What Obama has done is create a situation where the costs of private health insurance are just extraordinary, so the solution to the one-pay solution after this private system crashes is that, yes, we’ll probably get a universal health care program medical paid by the government, one payer, but it’s not going to be very good (and) you’re not going to be able to do very much with treatment.

When you eliminate at-risk so that everybody’s got to be covered and you can’t ask people questions that are embarrassing, I mean, it really is not even about pre-existing conditions except for this one group that does not want to get lifestyle questions asked, does not want to be penalized on health insurance because they’re going to live a lifestyle where the sexual activity of that lifestyle is still very highly correlated with a very infectious and very expensive disease: HIV/AIDS.

THWACK! – Supreme Court Shoots Down GOP Backed Liberty Counsel Lawsuit Over Obamacare.

Today the Supreme Court refused to hear an  attempt to overturn a key part of the Obama administration’s health care law by the heavily GOP backed extremist right wing hate group The Liberty Counsel

The justices did not comment Monday in leaving in place a federal appeals court ruling dismissing Liberty University’s lawsuit. Liberty made several arguments in challenging the portion of the health care law that requires most employers to provide health insurance to their workers or pay a fine. The 4th U.S. Circuit of Appeals in Richmond, Va., rejected those claims.

Said  Mat Staver the head the LC:

“Deciding the case would have highlighted the absurdity of the Supreme Court’s convoluted decision upholding the individual mandate as a tax. Apparently the court was not willing right now to venture back into that morass. We will wait on the court’s ruling next year to decide whether to file a new challenge. It is possible the high court could side-step the HHS abortion mandate issue by deciding that for-profit corporations do not have free exercise of religion rights. I hope the court will decide the issue and strike down this most egregious trampling of the free exercise of religion.”
