11th Circuit U.S. Court of Appeals Rules Bans on LGBT Conversion Therapy Torture for Minors Unconstitutional

The state of Florida doesn’t ban conversion therapy statewide, but the city of Boca Raton and Palm Beach County passed ordinances in 2017 that banned licensed professionals from treating minors with “any counseling, practice or treatment performed with the goal of changing an individual’s sexual orientation or gender identity.

Two anti-LGBT conversion therapists sued, arguing that the therapy they provided is voluntary, offered to clients who wish to reduce their attraction to individuals of the same sex or to reduce feelings of being the wrong gender. They claimed that the therapy they were providing consisted entirely of speech, and is therefore protected by the First Amendment.

Despite the fact that the American Psychological Association has found that sexual orientation change efforts have not been shown to be effective or safe in a 47-page decision for Otto v. City of Boca Raton, a circuit panel of the U.S. Court of Appeals for the 11th Circuit ruled, 2-1, (the 2 votes to overturn Judge Barbara Lagoa and Judge Britt Grant are both Republicans and Donald Trump appointees) that this conversion therapy is, indeed, protected speech under the First Amendment.

This decision allows speech that many find concerning—even dangerous. But consider the alternative. If the speech restrictions in these ordinances can stand, then so can their inverse. Local communities could prevent therapists from validating a client’s same-sex attractions if the city council deemed that message harmful. And the same goes for gender transition—counseling supporting a client’s gender identification could be banned. It comes down to this: if the plaintiffs’ perspective is not allowed here, then the defendants’ perspective can be banned elsewhere. People have intense moral, religious, and spiritual views about these matters—on all sides. And that is exactly why the First Amendment does not allow communities to determine how their neighbors may be counseled about matters of sexual orientation or gender.

“If there is a bedrock principle underlying the First Amendment, it is that the government may not prohibit the expression of an idea simply because society finds the idea itself offensive or disagreeable.” Texas v. Johnson, 491 U.S. 397, 414 (1989). The challenged ordinances violate that principle, and the district court should have enjoined their enforcement. We therefore REVERSE the district court’s order and REMAND for entry of a preliminary injunction consistent with this opinion”

The ruling has now created a circuit court split. In 2013, the U.S. Court of Appeals for the 9th Circuit ruled that California’s law banning conversion therapy for minors did not violate the First Amendment.  Because of this the debate over whether conversion therapy is a form of protected speech may ultimately end up before the now conservative heavy Supreme Court.

LGBT Hate Groups Received Millions of Dollars in COVID-19 PPP Small Business Loans

It has been exposed that LGBT hate groups, anti-immigration groups and anti-Muslim groups have received MILLIONS of dollars in government-aid backed Paycheck Protection Program (PPP) , intended for small businesses with 10 or fewer employees that have been harmed by the ongoing COVID-19 epidemic.

The groups include the anti-Muslim organization The Center for Security Policy; the two anti-immigrant groups, the Center for Immigration Studies and the Federation for American Immigration Reform; and three rabidly anti-LGBTQ groups, the American Family Association (AFA), Liberty Counsel and the Pacific Justice Institute (PJI).

The  Liberty Counsel received somewhere between $350,000 and $1 million from the PPP program while listing they had no jobs to retain . It is unclear what Liberty Counsel was planning to do with its hundreds of thousands in government loans but I am sure we can all guess.

The largest loan went to the anti-LGBT hate group the American Family Association, which was allotted between $1 million and $2 million to support 124 jobs.

In its 2017 tax filing, which is the latest available, the AFA reported revenues exceeding $18.4 million, net assets of about $30 million.

In 2010 AFA’s most notorious wingnut Bryan Fischer blamed gay men for being Nazis and causing the holocaust.

Jacksonville, FL Anti-Discrimination LGBT Ordinance Struck Down by Court

Jacksonville, Florida’s anti-discrimination ordinance, which banned discrimination on the basis of sexual orientation or gender identity, was deemed unenforceable in a unanimous appellate court decision Friday and struck down on Friday.

The reason for the court’s decision supposedly had to do with Jacksonville’s City Council and the way it handled the ordinance saying that it would amend the anti-discrimination laws to include sexual orientation and gender identity, but the council never actually did that.

“Instead of setting out the full text of the amendments in context, the proposed ordinance stated that the City’s office of general counsel would write the amended ordinance later,” the court ruled. “That had not happened yet when Appellants filed their original or amended complaints. There was no full-text version of each amended provision showing the insertion of new language.

″… Without all of that, an amendment is just an idea. Ideas alone are not enforceable.

Roger Gannam, the assistant vice president of legal affairs at the anti-LGBT hate group the Liberty Counsel. who both lobbied against the ordinance and who brought the lawsuit against the city, said he believed the City Council tried to file a shorter version of the bill so that it would seem like it wasn’t a significant change.

Incoming Jacksonville City Council President Tommy Hazouri said if the city’s lawyers decide not to appeal, then the council should quickly pass a technical fix, rather than re-debating the issue or passing a stronger form of the law.

“We meant what we said, and we said what we meant,” he said. “I’m not looking at a second bite. I’m looking to correct what the courts have asked us to do.”

He also said the court was “blind to justice” and he faulted the court for being “pretty conservative.”

The U.S. Supreme Court ruled in 1990 that burning the American flag is First Amendment protected speech. But if you burn an LGBT flag, it’s another story. An Iowa court just sentenced a man to 16 years in prison after he torched an LGBT flag.

That’s a hate crime in Iowa, which means Adolfo Martinez, who stole the pro-homosexual banner off a church and used lighter fluid to set it aflame, will spend the next decade-and-a-half behind bars.

What he did was wrong, but no one was hurt or verbally threatened. Sixteen years is an extreme and disproportionate sentence. It’s also an ominous signal of LGBT power and the growing threat it poses to your freedom and mine.

That’s why—with your help—we fought throughout this year to STOP the radical LGBT assault on freedom misnamed as the “Equality Act.”

What Mat Staver doesn’t mention and what many don’t know is that Martinez got such a long sentence because Iowa has a three strikes-style mandatory sentencing guideline passed by the Republican state legislature. Not only because he torched a rainbow PRIDE flag.

Since its inception in 1994, Staver has served on the board of Timothy Plan, a family of mutual funds and Exchange Traded Funds (ETF). Timothy Plan does biblically responsible investing principles and only owns companies that do not promote alcohol, tobacco, abortion and pornography.

When Donald Trump assumed the presidency, conservative religious leaders drew up “wish lists’ of steps they hoped he’d take to oppose abortion and rein in the LGBTQ-rights movement. With a flurry of recent actions, Trump’s administration is now winning their praise for aggressively fulfilling many of their goals.

Mat Staver, president of the legal advocacy organization (and LGBT hate group) Liberty Counsel, said Trump has fulfilled about 90% of the goals on a list that Staver and other conservative leaders compiled.

“In the first two years of his administration, he’s achieved more than all of the presidents combined since Ronald Reagan,” Staver said. “He’s been the most pro-religious freedom and pro-life president in modern history.”

The Log Cabin Republicans were unavailable for comment.

Liberty Counsel Hate Group Leader Mat Staver: The “Q” in LGBTQ Includes Pedophiles

Liberty Counsel’s Mat Staver appeared on conservative “Christian” radio show Crosstalk last week to continue the Religious Right’s dishonest drumbeat against a non-binding resolution passed by the California General Assembly that calls on religious and other leaders to promote equitable and compassionate treatment of LGBTQ people in the state.

But Staver went even further, charging that the addition of the “Q” to “LGBT” in the text of the resolution meant that it was promoting a “spectrum” that includes not only those who are homosexual or “gender confused,” but also “minor-attracted individuals” which he described as “somebody who wants to have sexual relationships with someone under the legal age.”

Staver repeated that charge when the conversation shifted to talk about federal legislation and cases awaiting Supreme Court action on whether the Civil Rights Act’s ban on discrimination on the basis of sex applies to discrimination on the basis of sexual orientation or gender identity. Staver denounced the Equality Act as “an LGBT propaganda bill” and the Do No Harm Act, which he said would “gut” the Religious Freedom Restoration Act.

Staver has warned about homosexuality, abortion, and the consequences for Christians who oppose homosexuality and marriage equality, saying they will be targeted for their views. He even went so far as to call for a new revolutionary war as marriage equality advanced. In March of 2015, Staver stated that he would personally advocate disobedience to any U.S. Supreme Court ruling that favored marriage equality, and that “collectively, we cannot accept that as the rule of law.” During the 2015 brouhaha over Indiana’s religious freedom law, Staver likened “the homosexual lobby” to terrorists, claiming that “it’s hard to negotiate with people who are irrational and who are inventing things that simply don’t exist.” Ehhhhhm.

Using the imaginary “gay pedophile” has been Staver’s modus operandi for years.

In August 2015 he said:

With the passage of the LGBT Equality Act in the House of Representatives so comes the crazy propaganda and criticisms from anti-gay hate group leaders.

First up we have Family Research Council president and white supremacist Tony Perkins via press release:

As the Equality Act (H.R. 5) just passed in the U.S. House of Representatives, I remind you, that this is an all-out assault on parental rights, on the family, and on the millions of people of faith in this country. The legislation goes far beyond just quarantining faith behind the four walls of a house of worship.

This act quarantines faith within your mind and says that’s where it must stay. It creates a world that punishes those who exercise their freedom to believe and live according to those beliefs. No institution or person of faith, be it a school, church, synagogue, mosque, business, or non-profit will escape its Orwellian reach.

The Religious Freedom Restoration Act will be committed to the “memory hole.” We will then experience a catastrophic loss of religious freedom in America, and, as a result, every American, those who believe and do not believe, will suffer the consequences. The American people must continue to speak with great force and clarity in opposition to the “In-equality” Act.

Next we have Matt Staver of the Liberty Counsel via press release: (Staver has claimed the Equality Act will “open the door” to pedophilia, ban the bible, and cause a rise in sexual assaults.

The U.S. House passed 236-173 HR 5, misnamed the “Equality Act,” with eight Republicans voting in favor and no Democrats voting against it. The eight Republicans are: Susan Brooks (IN-05); Brian Fitzpatrick (PA-01); Elise Stefanik (NY-21); Greg Walden (OR-02); John Katko (NY-24); Mario Diaz-Balart (FL-25); Tom Reed (NY-23); and Will Hurd (TX-23).

“No one who voted for the misnamed ‘Equality Act’ deserves to serve in Congress,” said Mat Staver, Founder and Chairman of Liberty Counsel. “This bill destroys the fundamental religious freedom on which America was founded.”

“This bill is unpatriotic and dangerous. The misnamed ‘Equality Act’ has nothing to do with equality and is the most serious threat to life and liberty ever proposed by Congress. This bill needs to be stopped in the Senate. If this bill becomes law, the consequences are staggering,” said Staver.

And last but not least we have a crazy rant from the “Christian Crypt Keeper” himself Pat Robertson of the 700 Club himself who claims that
God will “vomit” & “get rid of” America if the Equality Act passes into law.

This is a devastating blow to religious freedom and to the sanctity of America.

If you want to bring the judgment of God on this nation, you just keep this stuff up. You know, I was reading in Leviticus where it said, ‘Because of these things, the land will vomit you out.’ Vomit you out. I think God will say, ‘I’ve had it with America, if you do this kind of stuff, I’m going to get rid of you as a nation.

There is plenty of stuff that is going on, when you look at the potential of atomic war, when you look at the potential of a solar strike or something on our grid, you could go down the line of devastation that could happen to our nation. We don’t want that. We want the blessing of God, not the curse of God

Mat Staver of the anti-gay “Christian” law group the Liberty Counsel has spit out the false propaganda statement that gay men and pedophilia are connected that dates back to the 1960’s to attack the Equality Act that will amend the 1964 Civil Rights Act to provide employment, housing, and public accommodation protections to the GLBT community that everyone else, including religions have in the United States.

Other than the fact that the Equality Act has absolutely NOTHING to do with the age of consent laws in this country. Staver seems to forget that the door to pedophilia is located on the front of the Vatican, and your Catholic church.
