Gay History – July 28, 1961: Illinois Becomes First State to Rescind Sodomy Law By Mistake

In 1955, the Illinois General Assembly inaugurated the gargantuan task of overhauling its criminal code. Since its last major revision in 1874, the code had accumulated a patchwork of conflicting and confusing statues, some of which made no sense in the 20th century. Horse thieves, for example, were punished with a minimum penalty of three years in prison, but the maximum penalty for auto theft was only one year.

Over the ensuing six years, an eighteen-member joint committee of the Chicago and Illinois Bar Associations combed through the 148 chapters and 832 sections of the old statute books, using the American Law Institute’s 1956 Model Penal Code as a guide. The ALI had put together its Model Penal Code because a number of states were planning to revise their criminal codes over the next decade, and the 1956 Model Code recommended the elimination of all prohibitions against consensual sexual activity between consenting adults, including those which criminalized homosexual activity and relationships. Because the Model Penal Code also touched on a plethora of other criminal statues, it’s likely that most Illinois lawmakers didn’t realize that they were repealing their anti-sodomy law by adopting the omnibus legislation. Nevertheless, the code was adopted and signed into law by Gov. Otto Kerner on  July 28th, 1961, and the anti-sodomy law’s repeal became effective on January 1, 1962.

That didn’t mean however that eliminating the state’s anti-sodomy law was entirely by mistake. A booklet describing the new code prepared for Chicago Police by Claude R. Sowele, assistant professor at Northwestern University’s law school, commented, “The Law should not be cluttered with matters of morality so long as they do not endanger the community. Morality should be left to the church, community and the individual’s own conscience.” While Illinois became the first state to legalize consensual adult same-sex relationships, the change in the state’s criminal code had few practical benefits for the state’s LGBT population, as police raids and harassment on other pretexts (or no pretext) would continue without letup for another two decades.

Illinois would remain the only state in the union to legalize consensual adult same-sex relationships until 1971, when Connecticut would finally rescind its sodomy law, followed by Colorado and Oregon (1972), Hawaii and North Dakota (1973), Ohio (1974), New Hampshire and New Mexico (1975). The big year was 1976, when California, Indiana, Maine, Washington and West Virginia stopped criminalizing homosexuality. By the time Lawrence v. Texas struck down all sodomy laws nationwide in 2003, thirty-six states, the District of Columbia and Puerto Rico had eliminated their anti-homosexuality laws, either by legislative action or by state court decisions.

City of Aurora, IL Revokes PRIDE Permits After Not Enough Police Volunteer For Duty

The City of Aurora, Illinois has revoked a special permit for the 2022 Aurora Pride Parade due to security staffing concerns. The city claims organizers failed to retain the number of law enforcement officers for the parade. Since it’s a private event, the city said officers have to volunteer their time to work security. Last month, parade organizers sparked controversy when they announced they would not allow police officers to march in the parade in full uniform or bring police vehicles.

BOOM! There it is! “Last month ….. they announced they would not allow police officers to march in the parade in full uniform.” And they are SHOCKED that the Aurora police department doesn’t want to “volunteer”. You can’t insult the people you need and then complain when said people don’t want to volunteer.

Aurora, population 200,000, is usually host to the state’s second-largest Pride parade. But not anymore!

No Police at PRIDE is hyperbolic bullshit and there has never been a valid argument for it and never will be. Especially now in this current atmosphere of gun violence. Remember PULSE? It’s actually a miracle all considered that there has never been a mass shooting or major violence at PRIDE events in the the USA over the past 50 years.

Maybe because there were police in uniforms at them?

The minority, and it is indeed a minority with very big mouths who want no Police at PRIDE because they “feel” uneasy will be putting all in danger. Sometimes people need to be reminded. Feelings are not facts. We have SO MANY other important issues that should be prioritized and worked on. If police at PRIDE is your most important self issue. Then you are extremely selfish and care nothing about the rest of your community.

In fact. You have no PRIDE.

Harsh words but true. And believe me it had to be said.

Conservative lawmakers in 16 mostly red states across America are considering new legislation that would bar teachers from “introducing concepts of sexual orientation or gender identity to young students”, imitating a new Florida law that opponents have dubbed the “Don’t Say Gay” Law.

Falling back on the Ron DeSantis’ and Anita Bryant’s “Save The Children Campaign” playbook of “gay panic” the following states all have anti-LGBT legislation in the works.: Florida, Georgia, Louisiana, Oklahoma, Tennessee, Alabama, Arizona, Iowa, New Jersey, Kansas, Missouri, Kentucky, South Carolina, Illinois, Rhode Island, Ohio, and South Dakota.

“Battles over sex education in schools have been a constant front in the culture wars that have raged between liberals and conservatives for decades” aid Aaron Ridings, chief of staff and deputy executive director for public policy and research at GLSEN. ““There’s a chilling effect from all of these bills on people who are LGBT”

Youth Minister at Anti-Gay Illinois Church Charged With Sexually Exploiting Teen Boy

Authorities claim Paxton Singer, a youth pastor at Harvest Bible Chapel in Aurora, Illinois, asked a 16-year-old for nude photos, inquired about the teen’s sexual habits and requested the two spend the weekend alone together.

Prosecutors says Singer, “knowingly enticed a person under 17 years of age to remove their clothing for the purpose of sexual arousal or gratification of the defendant or the child.” He faces a misdemeanor charges of disorderly conduct and sexual exploitation of a child.

Singer also worked at the Harvest Bible Chapel campus in Rolling Meadows, about 40 miles away. Church officials disclosed there were also allegations of inappropriate actions between Singer and three different male teens there also.

Harvest Bible Chapel is a large anti-gay evangelical organization with congregations across the metro Chicago area. In its bylaws, Harvest asserts that God “is the sole authority in matters of marriage and sexuality for all people, and that marriage involves the sacred joining together of one man and one woman in faithful, permanent union.” and also condemns sex outside of heterosexual marriage and prohibits “‘sexual immorality’ activities related to: lustful thoughts, adultery, fornication, pornography, homosexuality, bisexuality or polygamy.”

Illinois House Approves Bill That LGBT History Be Taught In Schools

The Illinois state House of Representatives voted Wednesday to approve a bill to includes historical figures in the LGBT civil rights movement in K-12 history textbooks and requires schools to include “the role and contributions of lesbian, gay, bisexual, and transgender people in the history of this country and this State” in official textbooks.

The educational method is intended to reduce anti-LGBT bullying in schools by teaching students about the historical place of LGBT figures in American society.

“We think all students are better off when we teach them the full breadth of history,” Brian Johnson, the CEO of the LGBT organization Equality Illinois, said of the bill last year. “It makes them more likely to understand that a diverse cast has contributed to our society.”

Anti-LGBT “Christian” groups like Concerned Christian Americans and the Illinois Family Institute, which has been declared an LGBT hate group cited their own “religious objections” and those of some unnamed students families.

“It is well known that the controversies of the transgender and homosexual movements are in direct contradiction to the clear Judeo-Christian beliefs of many in Illinois,” said Illinois Family Institute lobbyist Ralph Rivera, in a memo to legislators. “Schools should teach that we should be respectful of each student and each person. This is what we all agree on. However, schools should not be used to advocate for lifestyles that are against the religious values of the students and parents.”

The measure now heads to Gov. J.B. Pritzker’s (D) desk where he is expected to sign it.

An Illinois House Republican lawmaker who had been appointed to the General Assembly’s sexual harassment task force resigned Wednesday following his ex-girlfriend’s allegations of improper sexual activity online, House GOP Leader Jim Durkin said.

State Rep. Nick Sauer, of Lake Barrington, was accused by an ex-girlfriend of sending nude photos of her to other men online, according to a report from Politico published Wednesday. The ex-girlfriend has filed a complaint about the matter with the Chicago Police Department and the Office of the Legislative Inspector General, Politico reported.

In a resignation letter, Sauer wrote that he decided to resign “as a result of the allegations” by “a former girlfriend.” “After speaking with my family, I feel it best to step away from my public responsibilities,” the letter reads.

It was Sauer’s ex-girlfriend Kate Kelly who filed a with the Office of the Legislative Inspector General, accusing the lawmaker of creating a fake Instagram account and sending nude photos of her to “lure them into graphic discussions of a sexual nature.”

In a letter to the Clerk of the House, Sauer acknowledged the allegation.

“My ability to fulfill my obligations as a state representative and public servant will be affected by the distraction of addressing these allegations,” Sauer said in the statement. “After speaking with my family, I feel it is best to step away from my public responsibilities.”

Ironically, Sauer was a first term republican lawmaker from Lake Barrington, and was a member of the House Sexual Discrimination and Harassment Task Force.

Arthur Jones, a Holocaust denier and “long-time neo-Nazi” whose website promotes anti-Semitic material, is the Republican Party’s official candidate in a congressional district spanning areas of Chicago after he ran unopposed in a primary.

The 70-year-old Vietnam War veteran, who is standing in Illinois’ 3rd Congressional district for a seat in the House of Representatives, is a notorious white supremacist. His own party, the Illinois Republicans, denounced him and he will not receive the GOP’s endorsement as a candidate.

Jones is a former leader of the American Nazi Party has has spoken publicly at numerous neo-Nazi rallies and events, and protested the opening of the Holocaust museum in Illinois as well as participated in events celebrating Adolf Hitler’s birthday.

“The idea that ‘Six Million Jews’ were killed by the National Socialist government of Germany, in World War II, is the biggest, blackest lie in history. Other than a few Professional Concentration Camp Survivors, such as the late Simon Wiesenthal or the current Semitic super star Elie Wiesel, there is no proof such a so-called ‘Holocaust’ ever took place anywhere in Europe, against the Jews.” Jones said.

Jones says he’s “Pro-Life–Yes. Homosexual Agenda–No!” He is against giving any money to Planned Parenthood and says the “homosexual movement” is an assault on the teachings of Christianity.

Nancy Pelosi Endorses Anti-Gay, Anti-Abortion Illinois Democrat Democratic Rep. Dan Lipinski

House Minority Leader Nancy Pelosi,, said on Thursday that she supports Rep. Dan Lipinski, D-Ill., and his bid for re-election, even as other Democrats have said they oppose him because he opposes legal abortion and LGBT rights.

The seven-term congressman from Chicago, who opposes abortion and voted against Obamacare, marriage equality and immigration reform, is the most conservative member of the House Democratic Caucus and so far right of center he might as well be a Republican but that doesn’t stop Pelosi.

“This is the Democratic Party. This is not a rubber-stamp party,” Pelosi said in an interview with the Washington Post in May.

Lipinski’s position on abortion and LGBT rights has drawn strong opposition from progressive and pro-abortion lawmakers such as Reps. Jan Schakowsky, D-Ill., and Luis Gutierrez, D-Ill., both of whom have endorsed his primary challenger, Marie Newman. Lipinski has not been endorsed by the Democratic Congressional Campaign Committee. 

DNC President Tom Perez said, “Every Democrat, like every American, should support a woman’s right to make her own choices about her body and her health. That is not negotiable and should not change city by city or state by state.”

Lipinski said that “Democrats have to know that they’re going to have the full support [of the DCCC] even if they’re not straight in the party line,” and that the party will need candidates who are not straight in the party line if they want to win back a majority.

Pelosi’s support for Lipinski is even more puzzling given that, as a member of the House Democratic caucus, he’s consistently voted against Pelosi’s own reelection bids to serve as Democratic leader. 

Illinois Sets New Policy For Social Workers, Families To Be ‘LGBT Affirming’ for At-Risk Kids

The Illinois Department of Child and Family Services (DCFS), which oversees the care of placement of some of the state’s most vulnerable children, has implemented sweeping mandates to promote the “well-being  LGBT children and youth in the Department’s care,” according to new agency guidelines.

The American Civil Liberties Union helped the DCFS design the policy that will affect not only children, staff and volunteers, but also applies to foster families, caseworkers, and even private contractors and their employees that work with the state agency. 

If a child or youth is known to be LGBTQ, the caseworker is responsible for determining prior to placement, the caregiver’s attitudes and beliefs regarding sexual orientation, gender identity/gender expression. In no instance should LGBTQ children/youth be placed with a non-affirming caregiver who is opposed to sexual orientations that differ from the caregiver’s own. Nor should LGBTQ children and youth be placed with caregivers who are unwilling/unable to support children and youth whose gender identity or gender expression differs from traditional expectation…If a caregiver is found to be non-affirming or is otherwise in violation of the nondiscrimination requirements in Appendix K, the youth’s DCFS caseworker must take immediate action to intervene and take appropriate corrective action and contact the LGBTQ Coordinator. (302- Appendix K, section e).

The policies, announced that DCFS staff and volunteers embrace the guidelines, and”will not tolerate exposing LGBTQ children and youth to staff/providers who are not supportive of children and youths’ right to self-determination of sexual/gender identity.” 

The 17-page document “sets mandatory minimum standards to promote the safety, adjustment and well-being of Lesbian, Gay, Bisexual, Transgender children and youth in the Department’s care” and prohibits “discrimination, bias, or harassment” on the part of DCFS employees or those of outsourced (purchase of service) agencies toward LGBTQ children, youth and their families.

David Hall, a Social Security Administration employee in  Illinois, says that he’d rather be fired than be forced to watch a workplace diversity video about the lesbian, gay, bisexual and transgender community. Hall claims that by doing so violates his religious beliefs.

Hall a 14 year employee of the SSA ,was told in April  to watch a 17-minute training video on LGBT diversity and inclusion and certify they’d done it afterward. Hall claims the department has never made a video mandatory before.

He was given direct orders on June 2 and again on June 24 and he refused both times. Hall said he is a Christian — “not anti-anyone or anything,” but “for God, for Jesus” — and believes the Bible teaches that homosexuality is a sin. He asked for religious accommodation but was denied. An official reprimand was placed in his file and he was suspended without pay for two days.

After the suspension, he was told he’d receive further discipline if he didn’t watch the video.

“I think this is an issue they are prepared to go to the mat with, but I’m not going to give up my faith or compromise my beliefs just to go along and get along. I don’t believe God wants me to do that,” Hall said.

“They wanted me to certify that I had completed the training,” says Hall. “I’m not going to certify an abomination.”

“I’m not judging the LGBT community … But I believe tolerance is a two-way street,” Hall said. “Unfortunately, I believe they’re wrong. But neither of us should lose our jobs or livelihood for our beliefs.

Doug Nguyen, communications director for the SSA’s Chicago region, wrote in a statement that “in support of an inclusive work environment, as well as exemplary customer service, the Social Security Administration recently announced a diversity and inclusion training on the Lesbian, Gay, Bisexual and Transgender (LGBT) Community to our employees.

“This mandatory video training reminds our employees of their responsibility, as representatives of the agency, to provide the highest levels of service to our customers,” Nguyen went on to say. “The training includes a brief session on tips for increasing cultural awareness in a diverse and inclusive environment. We are unable to comment on specific personnel matters.”

Hall has hired Chicago attorney Jason Craddock . He previously represented the owner of a bed and breakfast that refused to host same-sex weddings for religious reasons. The B&B turned down a couple’s request to hold a civil-union ceremony in 2011 and the judge ordered the B&B to pay $30,000 in damages to the couple and $50,000 in legal fees.
