Republican Sen. Peter Micciche today pre-filed a bill which would allow businesses to refuse service to any married or engaged same-sex couple.

Senator Peter Micciche (R-Soldotna) and Rep. Dave Talerico (R-Healy) have introduced bills in their respective chambers — SB 120 and HB 236 — which provide for individuals the right to deny marriage applicants “services, accommodations, facilities, goods, or privileges for a purpose related to the solemnization, formation, or celebration of a marriage.”

The sanctioning of refusal of services for a same-sex wedding could serve to undermine Anchorage’s newly passed anti-discrimination law, passed in September, which protects residents of Alaska’s largest city against “discrimination based on sexual orientation and gender identity.” It was the first law of its kind in the state.

Same-sex marriages were prohibited in Alaska via a 1998 ballot initiative. Last year, as we all know the U.S. Supreme Court overturned that prohibition in Obergefell v Hodges.

If moved forward and passed under the auspices of these Bills, the same opt-out clause could possibly also be applied in cases of race, age, disability, or national origin in the future
