Jon Hamm’s “HAMACONDA” Finally Has It’s Day In Court

After a long 6 year lawsuit over Jon Hamm’s “Hamaconda” a federal judge in the Southern District of New York has ruled that digital news outlet HuffPost didn’t violate copyright law when it published a photo of Jon Hamm with a black box digitally inserted over his dick in a 2014 article titled, “25 Things You Wish You Hadn’t Learned in 2013 and Must Forget in 2014. “

HuffPo lawyers argued that publishing their version of the photo was perfectly legal because it was “transformative.” HuffPo’s version contained a superimposed text box, photo caption, and a title, which together “fundamentally transformed the character and purpose of the [photograph’s] use.”

U.S. District Judge Ronnie Abrams agreed:

Here too, the photograph was used to illustrate what all the fuss is about, namely Hamm’s ‘privates’ and the public’s fixation with them,” the judge wrote.

Unlike the original Photograph, which Plaintiff claims had the objective purpose of “illustrat[ing] what Jon Hamm looks like wearing trousers in public while he walks down the street, ostensibly without any underwear,” Oath’s use of the Photograph served the dual purpose of mocking both Hamm and those who found the Photograph newsworthy in the first instance. The text box with the words “IMAGE LOADING” in all caps—a play on words that alludes to both the nature of digital technology and the body part at issue—suggests that Oath is making fun of Hamm, not merely “illustrating” his appearance.

Judge Abrams also inserted some shade at HuffPost in her ruling, noting that the article, listed multiple times as “25 Things You Wish You Hadn’t Learned in 2013 and Must Forget in 2014,” may or may not qualify as “news,” but it doesn’t really matter either way.

It must be noted that the lawsuit against HuffPo was not made by Jon Hamm but by the original photographer New York-based Lawrence Schwartzwald who sold the original photo to the Huffington Post.

3 Men Arrested In Connection to Murder of Gay Man in Virginia

The Loudoun County, Virginia Sheriff’s Office announced it had arrested Gavin Collins, 21, , and Joshua Hunter, 22, of Woodbridge, in the murder investigation of Jose Escobar Menendez.  A third man Handry Colindrez, 24, was arrested and charged with grand larceny for allegedly buying the car from Collins and Hunter.

According to the sheriff’s office, Menendez had agreed to meet Collins in the area of Emerald Point Terrace in Sterling during the early morning hours of July 8. But both Collins and Hunter showed up. During the course of their encounter, police allege that Collins and Hunter attempted to rob Menendez, shooting him fatally. The two then fled the scene, stealing Menendez’s car as well.

Hunter allegedly worked as an escort through the website Rent.Men for the past two years. A former customer provided a copy of Hunter’s page to a local media outlet. On the site, Hunter used the name “Anthony Adams,” and claimed that he was “a very open person with no hang ups and open to all genders.”

According to the FBI 2018 Hate Crimes Report on Sexual Orientation Bias 59.7 percent of the years cases were perpetuated against gay men.

Puerto Rico Gov. Wanda Vázquez Signs New Civil Code That Eliminates LGBT Rights and Protections

In a surprise move Puerto Rico Governor, Wanda Vázquez signed new civil codes into effect earlier this week that overhauls a series of laws regulating various rights, including LGBT rights. The changes and the fact that no public hearings were held has angered the LGBT community and many of the island’s citizens.

Among the 130 amendments in the newly approved code were provisions that eliminate the ability of transgender individuals to change the name and gender marker on their birth certificates — even though Vázquez claims that the process for amending a birth certificate remains the same — and removes legal protections for LGBT[Q] people that prohibit discrimination based on sexual orientation or gender identity.

Vázquez signed the new Civil Code against the backdrop of continued criticism of her administration’s response to the murders of nearly a dozen LGBT Puerto Ricans over the last year and a half.

In a prepared statement Governor Vasquez had the nerve to refernece George Floyd and also quoted Martin Luther King, Jr.

“Abuse, mistreatment, discrimination nor the violation of human rights in any way is neither acceptable nor permitted,” said Vázquez. “We all have a civic duty to respect that is fundamental in a peaceful society.”

Pedro Julio Serrano, founder of Puerto Rico Para Tod@s, a Puerto Rican LGBTQ advocacy group, in a statement noted: “They removed the discrimination bans in order not to include sexual orientation and gender identity. When they gouge LGBT+ (my acronym) people’s eyes out, they gouge everyone’s eyes out.”

San Juan Mayor Carmen Yulín Cruz also criticized Vázquez.

“With this signature to the Civil Code, the governor makes it clear that she has no words. And worse, she creates the scenario for a rollback of our rights.

On a personal note: This writer had planned a trip to Puerto Rico this November over Thanksgiving. This morning we have cancelled all reservations and airline tickets. We urge all in the LGBT community to do the same and avoid Puerto Rico as a tourist destination.

A gay assistant nursing manager at Mount Sinai Hospital in Manhattan, has died from the coronavirus, after being exposed to the disease due to the lack of personal protective equipment that has been widely reported at New York City hospitals.

The shortage of safety gear at one Manhattan hospital is so dire that desperate nurses have resorted to wearing trash bags — and some blame the situation for the coronavirus death of a beloved colleague. A stunning photo shared on social media shows three nurses at Mount Sinai West posing in a hallway while clad in large, black plastic trash bags fashioned into makeshift protective garb. … Meanwhile, staffers at the hospital near Columbus Circle on Wednesday tied the lack of basic supplies there to the death of assistant nursing manager Kious Kelly, who tested positive for coronavirus about two weeks ago. Kelly, 48, was admitted to Mount Sinai’s flagship hospital on the Upper East Side on March 17 and died Tuesday night, the workers said.

New York City had added 3,101 new confirmed coronavirus cases since the same time on Wednesday, bringing the total to 23,112.

The total number of virus-related deaths climbed to 365 on Thursday, up from 280 the day before.

Delaware GOP Chairman Forced To Resign After Posting Gay Slur on Facebook

Chris Rowe, the chair of the New Castle County Republican Committee in Delaware is being forced to resign his position after using a derogatory term for a gay man in a Facebook post. Rowe agreed to resign after GOP chairwoman Jane Brady called him Wednesday and asked him to step down from the appointed position.

Rowe has said that he making the decision “begrudgingly and only under duress.”

Rowe’s Facebook homophobic post about last Sunday’s Texas church shooting has been removed from his page.

“Faggots cannot handle reality,’’ Rowe had posted in response to a friend’s comment on his page.

After the post was discovered Rowe told the Delaware News Journal earlier that he wouldn’t apologize for using the slur. He called it “locker room talk” with a close friend and said he isn’t homophobic.

But after being told to resign he changed his story:

“I just got frustrated and used an improper word,’’ said Rowe “I made a mistake. God doesn’t create perfect people and I can verify that because I ain’t one.”

He said he never intended to offend gay people or anyone else.

“If the use of this word in any manner, injured or upset or really hit hard at the emotions of an individual and hurt them, really hurt them inside, I’m heartfully sorry,’’ Rowe said.

Regardless state GOP chair Jane Brady, a former Superior Court judge and attorney general who appointed Rowe, reiterated Friday that he had to step down.

Brady said she had spoken to many people within the party who were alarmed by the statement, and some who were not, before deciding her course of action.

“One of the people that called me said that they felt that this was a word that was used when they were in boot camp all the time, and I said, Well, what was the connotation then? It’s the same as the connotation now. It’s offensive.’ ”

The recent hacking into the Capital One database which is the largest breach in US history was allegedly done by a 33-year-old trans woman and software engineer named Paige A. Thompson. Thompson also threatened to “shoot up” a California social media company and was living in a house-turned-arsenal with a convicted felon who had once been arrested for being part of a “contract murder plot,” federal court papers in Seattle revealed.

Thompson was arrested Monday for allegedly hacking into a server rented by Capital One and obtaining the data of more than 100 million people.

It was not clear if any of the information Thompson allegedly snatched was passed to third-parties. She was charged with one count of computer fraud and abuse and faces up to five years in prison and a $250,000 fine.

Quan was arrested the same day after police raided his “modest” home and found in his bedroom “what can fairly be described as an arsenal of weapons, ammunition, and explosive material,” the court papers state.

Among other things, police found “several assault rifles, a sniper rifle, and hand guns,” the papers state. “Some of the guns were loaded, including one with a high capacity magazine. Further, some of the guns appears to be illegal firearms.”

On the social media site, Slack, a user by the name “Erratic,” and who was allegedly Thompson, in June boasted about having files taken from Capital One, according to the criminal complaint against her.

In a separate Twitter message obtained by the FBI, Thompson also described the Capital One hack as a suicide mission.

“I’ve basically strapped myself with a bomb vest,” Thompson wrote on June 18, according to court documents. “F–king dropping capitol ones dox and admitting it.”

Thompson also regularly shared details of her life on other social media sites as well, from information about her cat, Millie, to talking about her desire to kill herself. In one tweet claimed she was planning to travel to Denmark in October for legally assisted suicide.

It was a veterinarian letter Thompson posted on July 19 with her home address that ultimately led FBI agents to her door.

Detroit Man Accused of Murder Used GRINDR to Lure Victims

In a story that is becoming all to familiar, a 26-year-old man was charged with numerous felonies, including first-degree murder and four firearm counts, for allegedly assaulting two gay men in Detroit, one of whom died. by luring his victims using the gay sex hook-up app GRINDR.

Demetris Nelson used GRINDR to target 31-year-old Brian Anderson and 26-year-old Malcolm Drake focusing on them because of their sexual orientation. During an attempted robbery on July 6, Nelson shot and killed Anderson and critically wounded Drake.

“The allegations are that social media contacts were used to target, contact, rob, fatally shoot one gay man, and seriously wound another gay man,” Wayne County Prosecutor Kym Worthy said in a statement. “To some, this will be just another hateful and violent act in America. They will read about this case and continue to go about their day. To me, that is quite tragic.”

The case was assigned to Special Prosecutor Jaimie Powell Horowitz of the Fair Michigan Justice Project (FMJP)

Pastor at Alabama Anti-LGBT Baptist Church Arrested for Molesting Multiple Underage Boys

An anti-gay pastor has been charged with sexually assaulting multiple young boys at his Alabama congregation.
 
Pastor John Martin, of the Lighthouse Baptist Church of Florence, Alabama confessed to his congregation that he disgraced his family by having sex with two young boys. Members of his congregation then reported his crimes to authorities.
 
Martin was arrested on Friday, July 5 on four charges of first-degree sexual abuse.
 

One victim stated that the abuse began when he was 12 years old. According to the victim, one incident occurred at a birthday party for Martin’s son. The victim told police that Martin climbed into the tent of the boy when everyone else had fallen asleep.
 
According to the court records, Martin assaulted numerous boys from his church. Martin performed sex acts on the boys and forced the boys to perform sex acts on him.
 
Besides his church duties Martin also worked as a bus driver for a local school. One victim told police that Martin showed him nude photos while he was on the bus. The victim said that on multiple occasions Martin texted him to ask him “if he touched himself” that day.

Lighthouse Baptist Church which John Martin works at is part of the Independent Fundamental Baptist (IFB) denomination that holds extremist anti-LGBT beliefs.

From the church’s website:

“We believe that any form of homosexuality, lesbianism, bisexuality, bestiality, incest, fornication, adultery, and pornography are sinful perversions of God’s gift of sex. We believe that God disapproves of and forbids any attempt to alter one’s gender by surgery or appearance.”

The church continues,

“We believe that the only legitimate marriage is the joining of one man and one woman.”

The church also believes that men are the leaders of the family. Women are not allowed to serve as pastors. Additionally, the church does not believe in divorce and expects members to remain married until they die. Corporal punishment of children is also approved by the church to keep them in line.

John Martin’s bail has been set at $60,000., he will be required to wear an ankle monitor and cannot have contact with minor children.

Detroit Man Charged in the Murders of 2 Gay Men and 1 Trans Woman Over Memorial Day Weekend

A Detroit man charged with fatally shooting three people and wounding two others at a Detroit home over Memorial Day weekend which he targeted because they were gay or transgender..

18 year old Devon Robinson, of Detroit, was charged Thursday with three counts of first-degree murder, two counts of assault and weapons charges in the May 25 shooting on the city’s east side,

The shooting killed 21-year-old Alunte Davis, 20-year-old Paris Cameron and 20-year-old Timothy Blancher, all of Detroit. Davis and Blancher were gay men and Cameron was a transgender woman, the prosecutor’s office said.

Prosecutor’s spokeswoman Maria Miller provided the alleged motive in an email Friday but declined to release additional details, saying those would come out later in court. “The allegation is that … the homicide victims were targeted and killed because they were part of the LGBT community.”

“We must remain ever vigilant in our fight to eradicate hate,” prosecutor Kym Worthy said in a separate statement. “The alleged actions of this defendant are disturbing on so many levels, but the fact that this happened during Pride Month adds salt into the wound. “

Robinson is due in court Friday.

Neighbors in Charleston, SC Hoist PRIDE Flags In Solidarity After One Family’s Is Set On Fire

A straight family in Charleston, South Carolina, had their rainbow pride flag torn down from the front of their house and burned in their driveway last weekend.

“We were taken aback and thought, ‘Wow, somebody must be really bothered by this to go to this end here to do this.’ But we called the police to let them know about it,” the homeowner, who lives with his wife and three young children, told NBC News.

“There’s people on our street that have South Carolina flags, United States flags, different college flags, garden flags … obviously the rainbow is what attracted them to ours,” the homeowner, who asked that his name not be printed to protect his family’s safety and privacy, added. “I wouldn’t be surprised if the people who did this didn’t even know who we were or who lived in the home, that it was just the fact that it was a rainbow flag, and they didn’t agree with that.”

A local LGBT group, the Alliance for Full Acceptance, in return has offered free rainbow PRIDE flags to any residents or businesses in the city seeking to “display a flag in solidarity with the affected family and LGBT community.”

“So far, we’ve had 200 requests for flags,” the group’s executive director, Chase Glenn, said. “It’s really incredible to see the community rally around these folks and the LGBT community as a whole.”

Charles Francis, a spokesperson with the Charleston Police Department, said the investigation is ongoing, and no suspects have yet been identified.

If investigators conclude the incident is a hate crime, any suspects could be charged under Charleston’s new hate crime ordinance, which was passed in November of last year.
