Gay History – December 18, 1980: New York State Court of Appeals Strikes Down Sodomy Law

With the state of New York and especially New York City being such a mecca of progressive ideals its hard to believe that it was not until December 18, 1980 that New York became the twenty-fourth state in the nation to legalize homosexuality.  The Court of Appeals, the state’s highest court, struck down the New York’s consensual sodomy law in a 5-2 decision. The court ruled that the law violated Constitutional rights to privacy and equal protection, noting that the law banned anal and oral sex only when those acts were performed by unmarried couples. Married couples were exempt under the law. Writing for the majority, Judge Hugh Jones wrote:

“We express no view as to any theological, moral or psychological evaluations of consensual sodomy. It is not the function of the Penal Law or our governmental policy to provide for the enforcement of moral or theological values. …the People have failed to demonstrate how government interference with the practice of personal choice in matters of intimate sexual behavior out of view of the public and with no commercial component will serve to advance the cause of public morality or do anything other than restrict individual conduct and impose a concept of private morality chosen by the State.”

The Court concluded its ruling by stating:

“In sum, there has been no showing of any threat, either to participants or the public in general, in consequence of the voluntary engagement by adults in private, discreet, sodomous conduct. Absent is the factor of commercialization with the attendant evils commonly attached to the retailing of sexual pleasures; absent the elements of force or of involvement of minors which might constitute compulsion of unwilling participants or of those too young to make an informed choice, and absent too intrusion on the sensibilities of members of the public, many of whom would be offended by being exposed to the intimacies of others. Personal feelings of distaste for the conduct sought to be proscribed by New York Penal Law § 130.38 and even disapproval by a majority of the populace, if that disapproval were to be assumed, may not substitute for the required demonstration of a valid basis for intrusion by the State in an area of important personal decision protected under the right of privacy drawn from the United States Constitution – areas, the number and definition of which have steadily grown but, as the Supreme court has observed, the outer limits of which it has not yet marked.

Historic Fire Island Gay Landmarks Auctioned Off To Manhattan Hotelier Ian Reisner For $10.1 Million

Some of the most historical gay property in America next to The Stonewall Inn, namely the  business strip of the Fire Island Pines home to The Pavillion Nightclub, The Blue Whale, and the harbor-front which became a destination for millions of  gay men since it was founded in 1952 have been sold at auction for $10.1 Million dollars to Manhattan Hotelier Ian Reisner

Via the New York Times:

A strip of commercial real estate along the harbor in Fire Island Pines sold for $10.1 million at auction on Thursday to developers with plans to continue the revival of a former mecca for closeted gay men. The sale price was well below the $25 million the previous owners sought when they placed it on the market last fall, and below the $17 million they paid for it in 2010. In a deal hammered out over more than six hours, the property was bought by Ian Reisner, who also owns the Out NYC, a hotel on West 42nd Street in Manhattan that focuses on a gay clientele. The deal is expected to close in February.

In a telephone interview, Mr. Reisner said he, his business partner and a small team of investors planned to spend $4 million over the next 18 months to “renovate and rejuvenate” the property, which includes a hotel, a nightclub, a restaurant, a bar and retail space. The Pavilion nightclub in Fire Island Pines was rebuilt after a 2011 fire and reopened, but in the interim the crowd moved on. “My idea for the Out was to have a place for L.G.B.T., because we didn’t have that at the time,” said Mr. Reisner, who said he has been visiting Fire Island Pines since he came out as gay in 1989. “The Pines is the Out.”

Hopefully Mr. Reisner will see the historical value to the community and spotlight some of it in the rebuilding.

As for the writer of the New York Times article that this is quoted from, Ashley Southhall (@assouthall) who starts her article with:

“Meccaa for CLOSETED GAY MEN”?

Ms Southall you need to learn how to do research before you write a story.

Fire Island was a mecca for ALL GAY MEN,  LESBIANS,  BISEXUALS,  DRAG QUEENS, and TRANSGENDERED people  and their straight allies and friends for more decades than you have been alive.  What you wrote Ms. Southall is not only insulting to the entire gay community and  insulting New York Times readers who know more history than you.  To which it seems there are many.

 

 

 

New York LGBT Politicians DEMAND Obama Act On Russia’s Anti-Gay Human Rights Abuses

A group of gay and lesbian New York state legislators and NYC politicians including NYC Council Speaker Christine Quinn, state Sen. Brad Hoylman, Assemblywoman Deborah J. Glick, and Assemblyman Matthew Titone are demanding that President Obama respond and demounce Russia’s crackdown on LGBT people and cancel an upcoming meeting with Vladimir Putin.

Dear President Obama:

We write as lesbian, gay, bisexual and transgender (LGBT) elected officials from New York City in anticipation of your deciding whether to continue or cancel plans for an upcoming diplomatic trip to Russia to meet with Russian President Vladimir Putin. While you are considering whether to cancel that trip in light of Russia’s decision to give asylum to Edward Snowden, we also urge you to consider the country’s horrendous treatment of members of the LGBT community and its clear human rights abuses aimed at our community. Russia has become a country that persecutes anyone who might be LGBT or supports gay rights.

As then Secretary of State Hillary Clinton said on behalf of your administration, “Gay rights are human rights, and human rights are gay rights. It should never be a crime to be gay.” Given that President Putin and Russia have enacted laws to criminalize gay people and supporters and deny human rights to their LGBT citizens, they should not be the beneficiary of any trip by your office until they fully restore all civil rights to LGBT people in their country. Recent actions taken by the Russian government have led LGBT citizens to face not only a society that is intolerant of their basic civil rights, but also a country that would imprison them for declaring support for their own fundamental rights as humans. This has promoted an atmosphere of hate where gay people fear for their own lives and safety. Police are allowed to arrest foreigners who are considered gay or pro-gay and detain them for up to 14 days. Under their new law, as a pro-gay supporter even you could be subject to arrest and imprisonment while in Russia.

Mr. President, you will remember that in December 2011 the White House released a presidential memorandum directing executive officers and agencies that deal in foreign affairs to address human rights abuses against LGBT people abroad and to pressure foreign governments to decriminalize homosexuality. Now it is time for you and your administration to directly act on this memorandum. The LGBT community and its allies in Russia are under attack and the victims of clear human rights abuses. We urge you to stand in solidarity with us. Refuse any diplomatic mission to Russia until President Putin stops these abuses now and agrees to make Russia a country that proudly supports its LGBT community and its allies worldwide. We expect nothing less.

Other N.Y. political signatories  include Assemblyman Daniel O’Donnell, Assemblyman Micah Kellner, and NYC Council members Jimmy Van Bramer, Rosie Mendez, and Daniel Dromm.

Both President Obama and Secretary of State John Kerry have been silent about the atrocities being perpetrated against Russia’s LGBT community

New York The Next State To Move Towards Banning “Ex-Gay” Therapy

The state of New York is following the steps of several states that have taken steps to discussing a ban the reparative or ex-gay aversion therapy that says it can “cure” homosexuality for anyone under the age of 18. Here’s more:

Two New York lawmakers are introducing legislation to ban gay conversion therapy for minors, the practice of trying to “cure” people of being gay or lesbian. The bill is modeled after a similar ban in California that was signed into law last year, but has been temporarily blocked pending areview by the federal courts.

Lila Shapiro at Huffington Post reports:

Despite the unresolved legal challenge, two New York state lawmakers from New York City, Sen. Michael Gianaris and Sen. Deborah Glick, both progressive Democrats, said the time was right to propose a ban.

“There are often challenges to any manner of legislation that is protecting of the LGBT community and you can’t sit on your hands and wait until things get resolved somewhere else,” said Glick, who became the first openly gay legislator in New York in 1990.

California has already signed a law banning ex-gay therapy for minors that is now being challenged in court. During their investigation of the potential side effects of the therapy, the task force assigned by California found several potentially life threatening issues that may arise due to this therapy:

The task force concluded that sexual orientation change efforts can pose critical health risks to lesbian, gay, and bisexual people, including confusion, depression, guilt, helplessness, hopelessness, shame, social withdrawal, suicidality, substance abuse, stress, disappointment, self-blame, decreased self-esteem and authenticity to others, increased self-hatred, hostility and blame toward parents, feelings of anger and betrayal, loss of friends and potential romantic partners, problems in sexual and emotional intimacy, sexual dysfunction, high-risk sexual behaviors, a feeling of being dehumanized and untrue to self, a loss of faith, and a sense of having wasted time and resources.

Hopefully more states will take measures to ban this therapy for minors. There is still no sufficient evidence of any benefits of this therapy and to insist that homosexuality is something that needs to be fixed is appalling.

4 Men Busted In $274M Medicaid Grift Preying On AIDS Patients And Reselling HIV Meds

A pharmacist and three others of  MOMS Pharmacy, a nationwide HIV drug marketing business have been arrested in Long Island, New York for reselling life saving HIV medications which had been paid for by Medicaid

A pharmacist at the high-volume national HIV drug marketing business, which has sites in Brooklyn, Manhattan, and on Long Island, is charged along with three outside conspirators of running a $274 million black market venture. By relabeling prescription drugs of uncertain quality and origin, the defendants allegedly preyed on patients with HIV and cost the Medicaid program $155 million in New York. MOMS, whose parent is listed as Allion Healthcare, a Melville, L.I.-based company, billed New York State Medicaid for at least $155 million for these unusable drugs, according to New York State Attorney General Eric Schneiderman. The AG’s office says Allion cooperated in the investigation.

Charged with taking bribes is Glenn Schabel of Melville, the supervising pharmacist and compliance officer for MOMS, a company that puts together daily-dose packages of HIV drugs. The company advertises itself as offering “The best HIV/AIDS pharmacy care available” and will deliver drugs directly to patients’ homes.

Another licensed pharmacist, Babylon, L.I.-based Ira Gross is said to have brokered the sale of these drugs, which may have been stolen, expired, or improperly reused after being obtained from the patients for whom they were prescribed.

A Florida resident, Stephen Manuel Costa, is said to have created four separate entities to masquerade as wholesale distributors to sell the illegally obtained drugs.

The fourth defendant, Texas-based Harry Abolafia, is charged with creating false invoices to legitimize the transactions with the bogus wholesalers.

So disgusting and despicable words fail me.

People For the American Way Demands NY Town Clerks Issue Same Sex Marriage Licenses Or Be Replaced

People For The American Way have issued the follwing Press Release in response to reports that some town clerks in the state of New York are refusing to issue and sign marriage liscenses for same sex couples.

People For the American Way Foundation and Proskauer Rose, LLP, a global law firm, sent a letter this weekend to the Ledyard Town Board, demanding that the town’s clerk fulfill her legal duty to issue marriage licenses to same-sex couples. The letter refers to Ledyard Town Clerk Rose Marie Belforti, who had publicly stated that she will not sign marriage licenses for same-sex couples and refused to do so for Katie Carmichael and Deirdre DiBiaggio on August 30. With the Ledyard Town Board’s permission, Ms. Belforti decided to stop issuing marriage licenses altogether due to her opposition to the Marriage Equality Act, instead delegating the responsibility to a subordinate officer.

Upon appearing before Ms. Belforti for a marriage license on August 30th, Ms. Carmichael and Ms. DiBiaggio were told by the town clerk herself that they could not obtain a license that day and instead would need to return by appointment another day to meet with a subordinate official who would fulfill their request. Faced with discrimination by an elected official who placed her personal prejudices above the law, Katie Carmichael and Deirdre DiBiaggio turned to People For the American Way Foundation for help in realizing their right to wed.

Public officials can’t pick and choose the laws they want to follow. If a public official simply decides to shirk the obligations of her office, then she should resign and be replaced by someone who will do the job and carry out state law. Enforcement of the Marriage Equality Act is not subject to the opinion of town clerks – it is the right of all New Yorkers.

The Attorney General of the State of New York who should be bringing charges against these civil servants and/or elected officials who continue unlawful discrimination.  If Belforti  didn’t like a Jew marrying a Catholic or a Black man marrying a White woman.  Could she deny these requests?

There must be a clear guideline, otherwise, the couples wanting to marry will again be held hostage due to religious and political discrimination.

Video: NY Senator Greg Ball On Why He Voted NO On Same Sex Marriage: I Had To Protect The Bigots (And My Ass)

New York Senator Greg Ball appeared on CNN last night and explained to Anderson Cooper on why he flip flopped from a YES vote and chose to vote on the wrong side of history.

The answer?  he had to protect ALL the religious bigots of course.  Not just the church and clergy mind you.  But the homophobic photographers, caterers, D.J.’s and even limo drivers.  (Well that and he was scared shitless of NOM)

In ten years time, nobody will remember Greg Ball. He’ll be Mr Nobody. In contrast, all the other senators will be remembered, including Ball’s party colleagues in Seland and Grisanti.

Too bad Greg looks like you really did drop the ball. 

And it’s a shame. you are kinda good looking.  Too bad you are such a total douche.
