January 1, 2023: Kentucky Legalizes Medical Marijuana. Kind of.

Kentucky is currently one of only 13 states in the USA where medical/recreational marijuana is still illegal. On January 1, 2023 it’s STILL ILLEGAL in most cases but Kentuckians with certain medical conditions can legally possess medicinal marijuana — with several caveats which include driving hundreds of miles out of state to where recreational marijuana is legal and bringing it back to the state for medical use.

Democratic Gov. Andy Beshear tired of waiting signed an order taking action on medical marijuana after legislation on the matter stalled several times in Frankfort and objections by Rep. Thomas Massie and Senator Mitch McConnell both Republican.

Beshear’s executive action, signed Nov. 15, 2022, grants full pardons to those accused of marijuana possession so long as they meet several conditions:

  1. The marijuana must have been legally purchased in the U.S. Neighboring states Ohio, Illinois, Missouri and West Virginia currently allow sales of medical marijuana.
  2. Written proof of purchase, including date and location, must be on hand.
  3. The amount of medical cannabis possessed can’t exceed eight ounces.
  4. The individual or their caregiver has to present written, certified proof of an eligible medical condition.

Rep. Jason Nemes (R, Louisville) and other Republicans have pushed back against Gov. Beshear’s order, saying he doesn’t have the authority.

“The governor, no matter how much I agree with the issue, no matter how much one thinks a particular issue is good, they can’t just wipe out statutes,” said Nemes.

CAN YOU HELP?

Since 2008 Back2Stonewall has strived to educate the LGBT community about our history and noteworthy news stories. I have done so out of love, pocketing all expenses for all these years to avoid annoying potentially harmful ads. But due to the overwhelming medical bills I cannot continue on without your help. (And believe me I do hate to ask) As many of you know, and many don’t for the past 2 years I have been suffering with infections in first my left foot and then my right ankle which looks like it will have to be amputated in the near future. Medical bills, equipment, medications have wiped out my savings and retirement fund because I have been unable to work and disability retirement is extremely backed up because of COVID and quite simply I am out of funds to run the site or deal with my bills and mortgage.

If you can make a donation , any size to help keep Back2Stonewall and my life going it would be greatly appreciated and never forgotten.

Thank you: Will

Mexico HIGH Court Mandates Recreational Use of Marijuana Legal After Country Fumbles Law

Mexico HIGH Court Mandates Recreational Use of Marijuana Legal After Country Fumbles Law

Via The Associated Press:

Mexico’s Supreme Court ordered the government Monday to issue permits for the personal use of marijuana and for the growing of limited amounts of pot plants, after the country’s Congress took too long to approve a limited legalization law.

Under Monday’s court ruling, people who want to smoke marijuana or grow a few pot plants for their own use can ask for a government permit until some legislation is enacted. They would have to be adults, abstain from using marijuana around children and refrain from driving or engaging in other risky activities while under the influence.

Medicinal marijuana use has been legal in Mexico since 2017 . Only Uruguay allows recreational use of pot in the region.

So who is it exactly who is losing the drug war?

Mormons Try To Block Marijuana Vote By Using SCOTUS Anti-Gay "Religious Liberty" Cake Case

Mormons Try To Block Marijuana Vote By Using SCOTUS Anti-Gay “Religious Liberty” Cake Case

It is their second lawsuit intending to block voters from weighing in on on the use of medical marijuana in Utah a group of Mormon opponents of Proposition 2 filed a lawsuit in state court Wednesday, said the ballot initiative would tread on their “freedom of religion”.

Walter J. Plumb, an attorney and active member of The Church of Jesus Christ of Latter-day Saints who is the primary financier of the opposition campaign’s lawsuit takes issue with a provision of the ballot measure that would prevent landlords from not renting to a medical marijuana cardholder, saying that could create an issue of Mormon property owners being forced into renting to people who use cannabis.

Plumb’s “religious beliefs include a strict adherence to a code of health which precludes the consumption and possession of mind-altering drugs, substances and chemicals, which includes cannabis and its various derivatives,” the complaint states.

The group cites a recent U.S. Supreme Court ruling involving a Colorado bakery owner who declined to make a wedding cake for a gay couple, saying it would go against his religious beliefs.

“In the United States of America, members of all religions, including the Church of Jesus Christ of Latter Day Saints have a constitutional right to exercise their religious beliefs,” the complaint reads. “This includes the right not to consort with, be around, or do business with people engaging in activities which their religion finds repugnant.”

“The State of Utah is attempting to compel the speech of Utah landowners by suppressing their ability to speak out against cannabis use and consumption by only renting to tenants who do not possess or consume cannabis,” the complaint reads, “and who support their viewpoints in opposition against cannabis possession and consumption.”

The measure’s proponents seemed gleeful with the latest filing calling it a “wacky attempt” to stop Utahns from voting on it.

Puff, Puff, Pass: Senator Cory Booker To Introduce Bill To Legalize Marijuana

Sen. Cory Booker (D-N.J.) is introducing legislation to end the federal prohibition on water pipes wholesale price for marijuana and encourage states to legalize pot. The legislation, which Booker will formally roll out later Tuesday during a Facebook event, would amend the Controlled Substance Act to eliminate marijuana’s status as a Schedule 1 drug—a move that would decriminalize marijuana at the federal level.

It would also try to incentivize states to legalize marijuana if their current laws have a “disproportionate arrest rate” on minority or low-income individuals. Booker’s legislation would also be retroactive and require federal courts to expunge previous marijuana-related convictions. Individuals still in jail could petition to get their sentence shortened to comply with Booker’s bill. The Hill

Booker’s legislation would also be retroactive and require federal courts to expunge previous marijuana-related convictions. Individuals still in jail could petition to get their sentence shortened to comply with Booker’s bill.

Booker’s bill is probably all just an Acrylic Pipes dream and has little to no chance of passing.  Earlier this year Attorney General Jeff Sessions wrote to lawmakers  asking them not to block the Department of Justice from using funds to enforce federal marijuana laws.

Dreamy Canadian PM Justin Trudeau Introduces Bill To Completely Legalize Marijuana Use Nationwide April 13, 2017

Via The New York Times :

Fulfilling a campaign pledge, Prime Minister Justin Trudeau introduced legislation on Thursday to legalize the recreational use of marijuana in Canada. Many nations have either decriminalized marijuana, allowed it to be prescribed medically or effectively stopped enforcing laws against it. However, if you don’t want maijuana, then you can have purchase vaporizers. But when Mr. Trudeau’s bill passes as expected, Canada will become only the second nation, after Uruguay, to completely legalize marijuana as a consumer product.

The government’s plan has been broadly shaped by a panel of experts, but many issues still need to be worked out before legal sales can begin. Each of Canada’s provinces will need to decide exactly how the drug will be distributed and sold within its boundaries. The government will have to develop the marijuana equivalents of breathalyzers and a blood alcohol standard, so that drivers can be checked for impairment at the roadside and workers can be tested for safety on the job.

Shouldn’t Justin legalize it on 4/20?
